TERMS OF SERVICE
These Terms and Conditions (“Agreement”) govern the provision and use of wireless internet services (“Service”) provided by NEW SOURCE BROADBAND (“Company,” “we,” “our,” or “us”) to the customer (“Customer,” “you,” or “your”). By activating, using, or paying for the Service, you agree to be bound by this Agreement.
- Service Provision
- The Company will provide wireless internet access at the service address listed on your account.
- Service availability is subject to network coverage, line-of-sight requirements, and equipment limitations.
- The Company does not guarantee uninterrupted or error-free service and makes no warranty regarding speed, latency, or performance outside its control.
- Equipment
- Equipment required for the Service, including radios, antennas, routers, and cabling, may be provided by the Company or purchased by the Customer.
- Any Company-owned equipment remains the property of the Company. Customer agrees not to tamper with, relocate, or repair the equipment without prior authorization.
- Upon service termination, Customer must return all Company-owned equipment in good working condition within [X] days or be subject to replacement fees.
- Customer Responsibilities
- Customer is responsible for safeguarding login credentials, connected devices, and network security.
- Customer shall not resell, share, or redistribute the Service outside their household or business location without written consent from the Company.
- Customer agrees not to use the Service for unlawful purposes, including but not limited to:
- Distribution of viruses, malware, or harmful code
- Unauthorized access to networks or systems
- Spamming, phishing, or fraudulent communications
- Infringement of intellectual property
- Acceptable Use
- The Service is intended for personal or business use as agreed upon in the Customer’s plan.
- Excessive or abusive use that disrupts network performance for others may result in bandwidth throttling, service suspension, or termination.
- The Company reserves the right to monitor traffic patterns to ensure compliance with acceptable use policies.
- Service Fees and Billing
- Customer agrees to pay all service fees, installation charges, equipment rentals, and applicable taxes as stated in the service plan.
- Payments are due on or before the bill due date. Late payments may result in late fees, interest charges, or service suspension.
- Returned checks or failed electronic payments may be subject to processing fees.
- Installation and Access
- The Customer grants the Company and its contractors reasonable access to the premises for installation, maintenance, and equipment retrieval.
- Installation fees are non-refundable once service is activated.
- Service Interruptions
- Scheduled maintenance may result in temporary service disruptions, of which the Company will provide reasonable notice when possible.
- The Company is not liable for service interruptions caused by force majeure events, weather, interference, or factors outside its direct control.
- Cancellation and Termination
- Customer may cancel service with [X] days’ written notice. Early termination fees may apply if the Customer is under a contract.
- The Company may suspend or terminate service immediately if the Customer:
- Violates these Terms and Conditions
- Fails to pay outstanding balances
- Engages in unlawful use of the Service
- Limitation of Liability
- The Company is not liable for any damages, including but not limited to lost profits, data loss, or unauthorized access arising from the use or inability to use the Service.
- The Company’s total liability shall not exceed the fees paid by the Customer for the Service in the three (3) months preceding the claim.
- Indemnification
The Customer agrees to indemnify, defend, and hold the Company harmless from any claims, damages, or expenses arising out of the Customer’s use of the Service. - Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas without regard to conflict of law principles. - Amendments
The Company may update these Terms and Conditions at any time by providing notice through email, billing statements, or posting on its website. Continued use of the Service constitutes acceptance of any changes. - Entire Agreement
This Agreement, together with the Customer’s service order, constitutes the entire agreement between the parties and supersedes all prior oral or written statements.
Acknowledgment
By using the Service, the Customer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
